More than any election season before, Floridians heard all about abortion laws due to Amendment 4, the Right to Abortion Initiative. You may have seen advertisements everywhere and social media campaigns urging you to vote either “yes” or “no.”

What happened? What does it mean for Florida? And what other things do you need to know about Florida’s abortion laws in 2025? Keep reading for answers to all these questions.

Here are three things to know about Florida’s abortion laws in 2025:

#1. Amendment 4 Did Not Pass.

In order to amend Florida’s state constitution, there must be a 60% vote. Amendment 4, the Right to Abortion Initiative, received about 57% of the vote—not enough to pass.

This means that Florida’s constitution remains unchanged. If Amendment 4 had passed, women would have been able to get abortions through the age of fetal viability, which is around 23-24 weeks when an infant can survive outside the uterus.

#2. Elective Abortion Is Still Limited to Six Weeks.

Because Amendment 4 did not pass, abortion remains limited to before a heartbeat can be detected, which is around six weeks gestation. This six-week law, known as “The Heartbeat Protection Act,” went into effect in May 2024 due to Senate Bill 300

#3. There Are Exceptions for Abortion After Six Weeks.

While the six-week law does cover the majority of elective abortions, in specific cases, women can legally have abortions later. These exceptions include cases of pregnancy resulting from rape, incest, or human trafficking. Human trafficking is a newer exception and is available through 15 weeks of gestation.

If there is ever a medical emergency, a physician can terminate the pregnancy to save a woman’s life.
